مصنف/مصنفین: Bukhari، Syed Abdul Ghaffar
Allah is the real owner of sovereignty and ruler of the
universe. He honored the man in this world being His representative. The position awarded to Man is itself a very important responsibility. He cannot fulfil his obligations until he may be in a position to maintain balance between his rights and duties. This approach based on moderation is a realistic demand from the ruler and the people to be ruled as well. Ruler should use this authority with care. Ruler of a country possesses official authority as a sacred responsibility. Coming to a broader sense, one can say that all government and non-government positions and offices have been delegated powers and authorities. So it is necessary to use them responsibly. On the contrary, if these authorities are abused, entire social system will be spoiled. Prophet (r) of Islam was the first ruler who set such ethical standards that should be followed by the rulers of the world. Therefore, it is important that eligible individuals be appointed to important positions. We have clear and practical guidance from teachings of Prophet Muhammad (r) in this regard.

Islam is the only religion which is complete code of life. The needs of human beings have been felt and addressed properly. In spite of created by only one creator humans are different in their potentials, behavior and attitude. Owing to this difference, the incomes of people are drastically different from each other. As a result, a few people are rich and well off whereas some are poor- being up to sustenance level. Therefore, people cooperate with each other to eliminate the class differences of social strata. In this perspective, Islam has given an invulnerable perfect socio-economic system. For mutual cooperation, Islam has also addressed the issue and suggested different steps such as madharabah, partnership and tenancy. Bedsides Islam has also focused on secondary resources of mutual cooperation and support that are typically related to the personal concern. It includes: sacrifice, gift, free lending and Qarz-e- Hasanah etc. It also reflects that the man gives precedence to congregational matters over his individuality which is an ample example of mutual cooperation. In fact, mutual cooperation is one of those key factors on which the edifice of prosperous society is built. All religions and ideologies have focused and emphasized on the mutual cooperation; however, Islam lays extra emphasis to build a strong and thriving human state.
Before the advent of Islam, women were living in worst conditions during the Era of Ignorance. Daughters were buried alive. Women were openly sold in the market. A woman was just a source of enjoyment for males and nothing else. She had no basic rights. Even she had no share in inheritance. In human history, it is Islam that for the first time gave due respect to woman by providing her basic rights and proper status. Islam believes in equality of men and women – ‘Equality’ does not mean ‘to become identical’. Women’s rights in Islam pertain to Spiritual, Economic, Educational and Legal Rights. A woman can adopt any profession, she wants. Thus, she has got full freedom to live a happy and peaceful life. Unfortunately, there are many people who believe that because Islam gives men the right of having authority over their wives, therefore, men are superior to women and that men have priority over women in all matters. The fact is that according to Islamic teachings, men are not superior to women; and so women are not superior to men. There is no gender discrimination in Islam. Allah Almighty states very clearly in the Holy Quran that superior in His eyes are only those who have more taqwa (fear of Almighty Allah).

The term “Nikah Misyar” (translated sometimes as “travellers’ marriage” or “marriage of convenience”) is not found in the Qur’an, Sunna or classical works of Islamic jurisprudence. It is a term that has been introduced recently. However, the concept can be found being discussed in the works of classical Muslim jurists (fuqaha) . This is a marriage contract between a man and a woman, with the condition that the spouses give up one, two or several of their rights by their own free will. Some people consider that the misyar marriage can meet the needs of young people whose resources are too limited to settle down. However, there have been some (Sunni) scholars and organizations that have opposed the concept of Nikah Misyar altogether. As for the Islamic ruling concerning such marriages, there are two issues to consider: 1) Validity and permissibility; and 2) Appropriateness. Different scholars gave different opnions regarding these two imporatant issues. In this article, Nikah/zawaj Misyar was discussed in detail, describing different point of views and ruling in facvour and against Nikah Misyar.
A True Vision of Human Rights in Islam
Author: Tahir, Atique, Attaullah Mahmood Wattoo
If one accepts the premise of the Old Testament that Adam was created in the image of God, this implies that the divine stamp gives human beings a high value of worth. In similar vein, the Quran says: Surely we have accorded dignity to the Sons of Man. So too, in the Bhagavad-Gita: Who sees his Lord Within every creature deathlessly dwelling amidst the mortal: That man sees truly. Put another way, in a religious context, every human being is considered sacred. Believing in a common universal Divine force, which gives rise to a common humanity and from this flows a universality of certain rights. Since the rights stem from a divine source, they are inalienable by mortal authority. This concept is found not only in the Judaeo-Christian tradition but in Islam in its more advanced and wider perspective. The present study is an attempt to provide an epilogue on human rights given in the Qur’an and Sunnah. It is an in-depth analysis of Human Rights and dignity of person, encompassing its various dimensions. The study is an attempt to understand the true philosophy of human rights in Islam. It aims at providing an ethical and legal basis for the realization of implementation of human rights in the world states in general and in the Muslim states in particular.
