ABSTRACT This paper deals with Shariah and Tariqat. The decrees of Shariah have two kinds. One is related to the body (which is visible) , while the other one is about the soul (in visible) . Shariah is a combination of visible and un visible decrees. Tariqat is not a separate entity, it is cm integral part of Shariah. The people who consider Tariqat as a separate entity-, as a matter offact they are misguided persons. Tariqat is nothing but a subservient to Shariah. For the purification ofsoul and to make one self abiding by the laws of Shariah, the Sufia have proposed some specific practices and activities for their followers. They asked their followers to strictly adhere to these practices. Not only for the followers hut also for the spiritual guides; it is incumbent on them to follow the rules ofShariah whether these are related to body or to the soul. Irrespective of the position of the spiritual guide, he should also abide by the laws ofShariah. His Sufipractices. supernatural events or miracles have no value and no acceptance to the Almighty - Allah. Tariqat must be under the rules of Shariah, other wise it will not be accep

ABSTRACT The humanity witnesses a strange international phenomenon called the Globalization which endeavors to make an intellectual unification in the sphere of norms — education, social, economic and politics. This carries a strong challenge for the Muslim societies across the world. Through a focus on the educational, cultural, economical and politiiclal spheres and to employ the devices of communication — media and the internet. The world has shrunk into a small village which is diminishing the geographical, historical, political and educational boundaries. The world is undergoing the transition in materialistic and educational values and principles which are not accorded as per the Islamic values. Through media and interactive modes of communication. Hence, it becomes necessary to examine all aspects of this subject to be on a firm position of this transformation to preserve and safeguard our Muslim identity. In this context, the concept of globalization by Muslim and western scholars and its impact on globalization are discussed along with some proposals in order to cope with the negative effects ofglobalization in the Muslim societies.

ABSTRACT Family is the basic institution among all other institutions. Ifthis institution is good then the whole society will be good. Ifthis institution is not sound, then it is difficult to get good society. In this institution a woman play an important role, either that be a wife, mother, daughter or sister. In any condition we cannot deny her importance and her role in the general well-being of society. From the historical study we come to know that until the teaching ofthe prophets were followed, woman was honored. But when their teachings were neglected or mixed with personal interest then women were deprivedfrom their rights and were dishonored, As a result social system sufferedfrom disruption. The injustice with women was notjust in any particular culture or religion but in every culture and religion she remained under violence. When Holy prophet (PBUH) came, he saved her rights and responsibilities, so thatfamily should bepeaceful andsociety wouldget good citizens. A comparative study of women's rights has been presented in this paper, and it will be estimated that what other religions and cultures give rights to women and what Islam has given

ABSTRACT This article is focused on elaboration of the characteristics and requirements of the Islamic Judicial system. The judicial system of Islam is very comprehensive as well as simple one as compare to other existing judicial systems. It guarantees quick relief to the aggrieved parties. Judicial system of Islam consists of several components like, Judge, Sources of Qadha, Parties of dispute, matters of Qadha and decree. ABSTRACT Compilation and codification of Islamic jurisprudence is a great achievement of the Islamic literary history. The productivity andfertility of the mind of the Muslims Scholars was a true and brilliant field of cognitive process. In this respect the Imam Zufar (RA) (110AH) had been a great scholar in Ilanafi Canon with his unique multi-dimensional features and characteristics. He paved a different path to have difference of opinion with his great teacher Imam Abu Hanifa as well as with the rest offamous jurists. Wilayat al Mazalim is one of the ways to achieve the goal of administration ofjustice in a non-traditional way. The present article is an effort to explain the concept, meaning, methodology of this important department of the government and to highlight the qualifications and jurisdiction of its in charge, and to distinguish it from other similar departments. Towards the end the legal status of the task of Wilayat al MaSalim has been elaborated.

Right to Life As a Human Right: A Comparative Study of Shari’ah and Law

ABSTRACT: Right to Life is considered as one of the primordial Human Rights. The importance of right to life can be judged simply on this basis that there are diversified views ofthe leaders of the world regarding almost every issue about human Rights concern. However, they agree in principle that the individuals (lives) irrespective of their race, color, language and nationality, should be saved andprotected and they should be honored and respected. Even a cursory glance at the contents of the Islamic ideology indicates that the Qura'n and the Sunna'h have dealt in depth with nearly every aspect of human rights and in particular the right to life. The present study investigates different aspects and dimensions of ‘Right to life’ in the light of Islam, along with its comparison with law and western approaches to it.

A Sharia’h Perspective of Minimum Account Balance Requirement in Islamic Banking

ABSTRACT: Banks charge fee on saving and current accounts or downgrade them when the balance drops below a threshold point. This could be justified in conventional banking on pure business grounds; however, it is an issue of concern in Islamic banking because of the underlying Shari’a (Islamic Law) issues in this practice. While some Islamic banks charge incidental fees, as practiced by conventional banks, on accounts with low balances, others simply stop paying profits on such savings accounts and some even downgrade them by stopping some of the free sendees. This conceptual paper addresses the Shari'a aspect of such practices in Islamic banking. The paper first presents a broader picture of Islamic banks’ practices in relation to this issue and then explores relevant Shari'a principles. The current market practices are then analyzed in light of Shari’a principles. The findings reveal that imposing restrictions/ charges on low-balance savings and current accounts are against the basic tenets ofShari’a principles. The implications of the paper are twofold. Firstly, it opens up a whole new dimension of literature in the field of Islamic banking by instigating an important untouched area. Secondly, it strongly recommends that Islamic banks reconsider their practices in this regard in order to stay viable in the long run. The paper also gives alternative recommendations for addressing the problem in a Shari’a compliant way

Conflicting Images of Muslims in Post-9 11 American Literature

ABSTRACT: Since the advent ofIslam, Muslims have never ceased to be importantfor the West and have been variously depicted in English literature from time to time. However, after the tragic incidents of 11th September, 2001, there has been a dramatic change in the world'sfocus on them, both in nature and in magnitude. Both as Ummah—theformal Arabic word for the global community of Muslims —and as individuals, they have suddenlyfound themselves among the protagonists of English literature in general, and that produced in the North American Continent in particular. This paper aims at discussing the different images of Muslims and Islam in the English literature of North America, focusing on their nature, types, causes, consequences and the way they differ from the depiction of Muslims and Islam before the drastic disaster of nine-eleven. It also intends to contrast the literature authored by Muslim Americans about themselves with that written by non-Muslim Americans about them during the period infocus.
