سماج اور سماج فہمی
سماج
سماج لفظ سنسکرت زبان کے دو لفظوں سے مل کر بنا ہے۔"سم " اور "آج" سم کے معنی ہیں اکٹھا یا ایک ساتھ اور آج کے معنی ہیں رہنا۔یعنی سماج کے لغوی معنی ہیں ایک ساتھ رہنا۔ اس خیال سے جہاں افراد ایک جگہ جمع ہوجاتے ہیں وہیں سماج بن جاتا ہے۔انگریزی زبان میں معاشرے کے لئے سوسائٹی (society)کا لفظ استعمال کیا جاتا ہے۔ عمرانیات میں افراد کے باہمی تانے بانے کو معاشرہ کہتے ہیں۔ عموماًمعاشرے سے مراد افراد کا گروہ لیا جاتا ہے۔
’’لفظ سماج کے لغوی معنی معاشرہ سوسائٹی ،انجم،حلقہ،ٹولہ، یا صف کے ہیں اور یہ سنسکرت زبان کا لفظ ہے۔‘‘(1)
عام فہم الفاظ میں تو تمام انسانوں ہی کا مجموعہ سماج کہلاتا ہے۔لیکن اگر کوئی یہ سوال اٹھانا شروع کر دے کہ انسان کیا ہے؟ تو پھر انسان اور سماج دونوں کے وجود پر سوال اٹھنا شروع ہو جاتے ہیں اور دونوں ہی پیچیدہ تر ہوتے چلے جاتے ہیں۔انسان صرف گوشت پوست کا لوتھڑا تو نہیں ہے۔ یہ ایک ایسا صاحب شعور اور صاحب نطق جانور ہے جو صرف ایک وجود نما نہیں ہے۔ بلکہ اس وجود کی بقا کے لئے تمام مادی، جغرافیائی اور مالیاتی نظام کا نام بھی ہے۔
اس تعریف کے مطابق کوئی انسان اس وقت تک مکمل انسان کہلاہی نہیں سکتا جب تک اسے اپنی بقا کے لئے تمام تر "معیاری"اور"مناسب ماحول" حاصل نہیں ہو جاتا۔ اب معیاری اور مناسب ماحول کیا ہوتا ہے؟ کیونکہ فطرت نے ہمیں اپنے جینے کے لئے کوئی نہ کوئی معیاری اور مناسب ماحول فراہم نہیں کیا۔ اس کے لئے انسان نے خود تگ و دو کی ہے۔اس لیے یہ اضافی صفات بن گئی ہیں۔

Allah has made the man as his caliph on earth and created the natural resources of the universe for the sake of human beings. Due to advancement of industrialization the natural resources and environment have been threatened while the environmental pollution has become an international challenge in modern times. Some of the guiding principles mentioned in the Sirat-un-Nabiﷺ are helpful in basic guidance of humanity, such as the prohibition of extravagance and oppression, the gratitude for divine blessings, the observance of the rights of worship, and so on. However, there are certain rules and decrees that provide specific guidelines for the protection and proper use of certain natural resources, such as water, trees, agriculture, forests, wind, etc. That some of them have been ordered to perform their duties, Such as the commands to plant trees, to keep water clean, to cultivate, to raise animals and to be gentle with them, etc. Such as prohibitions of cutting down trees unnecessarily, of polluting water, of spoiling fields, and the prohibition of cruelty to animals, etc. In this study, these demands have been explained in some detail in the light of Quran and Hadiths. An Analytical Study of Wahbah Al-Zuhaylis Thought in Contemporary Islamic Jurisprudence

This dissertation aims at exploring the process of transmissionlearning and its impacts on the development of the ʻUlemā- the insightful scholastic class of Islam- with a special focus on the verbalization of Islamic orders. The bottom rock of this study is the academic of the twentieth century, Wahbah Muṣṭafā Zuḥaylī (1932-2015) who has extensively and substantially enriched the Islamic laws and legal jurisprudence through many of his speeches and books which deal broadly with various ramifications of Islamic cultures. His teachings are relevant to the whole Muslim world in general and to the Middle East in particular. He argues that religious compulsion to follow the Sunnī diktats is not compulsory for the faithful. He further maintains that the followers of Sunnī Islam are free to follow any of the four validated Sunni edicts, and even this is not compulsory as long as one follows a competent Islamic jurist. Heeven goesto the extent of permitting the people to follow the rules of other laws as long as they are not against the fundamental instructions of Islam. Zuḥaylī is of the opinion that relationships between Muslims and non-Muslims should be based on mutual respect, brotherhood,and universal understanding. He considers war only as a weapon of last resort. The first chapter of the dissertation is a prologue to al-Zuḥaylī. It embodies the social and scholarly ether of his time. The second chapterevaluates the diverse course of history through which the Islamic Law developed from the time of Holy Prophet صلى الله عليه وسلمdown to the current time. Third chapterscrutinizes the methodology of al-Zuḥaylī. The main focus of this chapter remains on how he has adopted the reason-based and otherworldly techniques to deal with the information inside the Islamic family law. Fourth chapterexplores al-Zuḥaylī‘s contribution on the laws of Islamic Business and Monetary Exchanges in the light of contemporary rules on business and monetary administration. Fifth and Sixth chapters discuss the chosen contemporary issues to comprehend Zuḥaylī‘s abilities to find solutions for the current issues. The conclusion of the dissertation encompasses the brief analysis of the over-all impacts of the writer on Islamic Law.
