مولانا سید منت اﷲ رحمانی مرحوم
دارالمصنفین میں یہ خبر نہایت غم و ندوہ کے ساتھ سنی گئی کہ امارت شرعیہ بہار و اڑیسہ کے امیر، مسلم پرسنل لا بورڈ کے جنرل سکریٹری، مسلم مجلس مشاورت کے بانی ممبر، دارالعلوم دیوبند و ندوہ کی مجلس انتظامیہ کے رکن اور خانقاہ رحمانی کے سجادہ نشین مولانا سید منت اﷲ رحمانی کا انتقال ۳ رمضان المبارک ۱۹؍ مارچ کی شب میں ہوگیا، اناﷲ وانا الیہ راجعون۔
ان کا مرثیہ صرف ایک عالم کا نہیں بلکہ ایک عالم کا ماتم ہے، ہندوستانی مسلمانوں کے لیے ان جیسی ستودہ و صفات ہستیاں اس دور قحط الرجال میں نعمت سے کم نہیں اور اس نعمت کے چھن جانے سے حرمان و نقصان کی کیفیت اور شدید ہوجاتی ہے۔
انھوں نے ایسے ماحول میں آنکھیں کھولیں جو علم و معرفت اور شریعت و طریقت کی دولت سے مالا مال تھا ان کے والد ماجد مولانا سید محمد علی مونگیریؒ، شاہ فضل رحمن گنج مراد آبادیؒ سے تعلق، رد عیسائیت، تحریک ندوۃ العلماء اور ردقادیانیت میں اپنے کارناموں کے سبب نمونہ سلف اور طبقہ علماء و مشائخ میں ممتاز حیثیت رکھتے تھے، ان کی اقامت کانپور میں تھی لیکن ہدایت و ارشاد کے لیے وہ مونگیر اور اس کے اطراف میں برابر تشریف لے جایا کرتے تھے، جب وہاں قادیانیت کا فتنہ زیادہ سنگین ہوا تو اس کا مکمل قلع قمع کرنے کے لیے ۱۳۲۰؁ھ میں انھوں نے مستقل طور پر مونگیر میں اقامت اختیار کی، مولانا منت اﷲ رحمانی ۱۳۳۲؁ھ میں پیدا ہوئے، اپنے بھائیوں میں وہ سب سے چھوٹے تھے، مولانا مونگیریؒ کے انتقال کے وقت ان کی عمر تقریباً دس برس تھی، ان سے بیعت تو حاصل ہوئی لیکن استفادہ کا زیادہ موقع نہ ملا، انھوں نے بعد میں دیوبند اور ندوہ میں بھی تعلیم حاصل کی، ندوہ میں وہ...

جج پر ضمان: فقہی قواعد اور پاکستانی قانون میں تطبیق

A judge should be honest,  transparent, free and fair. He should always respect law. The question arises that if a judge who disrespects law and makes unbalanced decisions: as a result of which people get affected then will he or she be penalized? The Ḥanafi Scholars opine that if a judge passes a wrong decision intentionally, he should be penalized from his own property. Because in Islamic jurisprudence, judiciary owns a supremacy over the masses and everyone irrespective of the position is equal and has to obey law. Whether he is a judge or a commoner, he has to follow the rules and regulations as prescribed by law. In practice, Pakistani judges are not held responsible for making a wrong verdict. Our judges make judgments on the basis of already manipulated evidence. A judge bars himself from the responsibility of collecting evidence. Similarly, if a judge has developed personal grudges with the criminal then the criminal reserves right of appealing the higher court where the decision is reviewed and rectified. In such situation, there is a compulsion between the legal maxim "وَالْأَصْلُ عَدَمُ الضَّمَان" and the Pakistani laws. However, Ḥanafi jurisprudence and Pakistani Laws are not in accordance with each other. This study concentrates upon the nature of punishment and tort to be applied on judges in case of making a decision based on falsehood. It is suggested that Pakistan’s Judiciary should be reread as that the already in-practice system does not comply with the standards of Islamic teachings.

Improved Inference under Heteroscedasticity of Unknown Form Using a New Class of Bootstrap and Nonparametric Estimators

It is well-known that use of ordinary least squares for estimation of linear regression model with heteroscedastic errors, always results into inefficient estimates of the parameters. Additionally, the consequence that attracts the serious attention of the researchers is the inconsistency of the usual covariance matrix estimator that, in turn, results in inaccurate inferences. The test statistics based on such covariance estimates are usually too liberal i.e., they tend to over-reject the true null hypothesis. To overcome such size distortion, White (1980) proposes a heteroscedasticity consistent covariance matrix estimator (HCCME) that is known as HC0 in literature. Then MacKinnon and White (1985) improve this estimator for small samples by presenting three more variants, HC1, HC2 and HC3. Additionally, in the presence of influential observations, Cribari-Neto (2004) presents HC4. An extensive available literature advocates the use of HCCME when the problem of heteroscedasticity of unknown from is faced. Parallel to HCCME, the use of bootstrap estimator, namely wild bootstrap estimator is also common to improve the inferences in the presence of heteroscedasticity of unknown form. The present work addresses the same issue of inference for linear heteroscedastic models using a class of improved consistent covariance estimators, including nonparametric and bootstrap estimators. To draw improved inference, we propose adaptive nonparametric versions of HCCME, bias-corrected versions of nonparametric HCCME, adaptive wild bootstrap estimators and weighted version of HCCME using some adaptive estimator, already available in literature, namely, proposed by Carroll (1982). The performance of all the estimators is evaluated by bias, mean square error (MSE), null rejection rate (NRR) and power of test after conducting extensive Monte Carlo simulations.
